Conditional rules

These rules apply only when the condition fits your product.

• If sizes 0 through 6X: 16 CFR part 1615
• If sizes 7 through 14: 16 CFR part 1616
• If tight-fitting or infant garment exempt from 1615/1616: 16 CFR part 1610
• If intended for ages 3 and under (possible child care article): 16 CFR part 1307
• If product has paint, ink, or a similar surface coating: 16 CFR part 1303

Notes

Sizes up to 6X must meet 16 CFR 1615; sizes 7-14 must meet 16 CFR 1616. These replace 16 CFR 1610 for covered items. Excluded: diapers and underwear, tight-fitting garments, and (for 0-6X) infant garments sized 9 months or smaller that meet length limits; excluded items still need 16 CFR 1610. Sleepwear for ages 3 and under may also count as a child care article for phthalates (facilitates sleep); CPSC sources checked do not say so directly. Whether wearable blankets / sleep sacks are treated as sleepwear was not confirmed from a CPSC source. HTS list = CPSC-flagged Wearing Apparel lines whose USITC text (below the heading) mentions sleepwear, pajamas, nightdresses, robes, or blanket sleepers; a few lines (e.g., silk pajamas) are not limited to children.
